"With regard to the 48-hour-notification timeline in Annex II to the General Terms & Conditions we point out that such short notification timelines are not customary in the market and difficult to flow down to possible subcontractors. As the bidder itself is subject to the strict data breach notification obligations of the GDPR, its incident procedures fully meet the requirements statutory by EU data protection law. Is it therefore possible to amend Annex II as follows: ""The Service Provider shall notify relevant personal data breaches to the controller without undue delay after the Service Provider becomes aware of the breach."

In accordance with article 4.6 of the General Administrative Submission Clauses, by submitting a tender, tenderers accept all Terms and Conditions of the procurement documents, including the EIB Model contract and waive their own terms of business. Consequently, tenderers are not allowed to negotiate the contractual provisions.
