I am enquiring about the IP Key China Action RFI, specifically the type of Chinese experience you are looking for from an IP provider. The tender documents are unclear as to what you mean by ‘experience of knowledge of working in China’ as European firms are not permitted to provide IP services within China, but can work with Chinese associates in relation to IPR enforcement within China. Presumably, this is what the tender documents are referring to when you ask for details of such experience? We are interested in submitting a response to the IP Key China Action RFI as we do a lot of work with Chinese-based firms, however we are unclear if this will be enough to qualify as having enough experience of knowledge of working in China. Could you please clarify this?

Thank you for your interest in this procedure. Only the evaluation committee specifically appointed for this purpose will be able to decide which experience can or cannot be considered to meet the selection criteria indicated in the “additional information” document and it will only be able to do so on the basis of the information submitted in the “request to participate”. We would nevertheless like to point out that, as you can see in point 3 of the additional information document, the technical capacity’s selection criterion 3.1. reads: “The candidate has provided continuous services in the People's Republic of China in the last three years”
